Seller`s guide

Documents needed to sell real estate in Poland:

 


If want to sell the plot:

  • purchase basis – sale or donation notarial act
  • valid copy of the mortgage book (the last 3 months)
  • actual extract from land register
  • actual certificate of land destination in the city or community development plan (or certificate of lack development plan for the parcel)
  • cadastral map
  • decision about amount of property tax
  • if the parcel is in perpetual usufruct – you need the contract about establishing this right and the decision about annual fee
  • if the property is inherited – you need a decision about acquisition of an inheritance and certificate about inheritance tax payment

 

 


If you want to sell the house (built-up property with residential building):

  • purchase basis – sale or donation notarial act
  • valid copy of the mortgage book (with disclosed building)
  • actual extract from land register
  • actual certificate of land destination in the city or community development plan
  • cadastral map
  • decision about amount of property tax
  • certificate of check-out residents
  • technical documentation
  • if the property is inherites – you need a decision about acquisition of an inheritance and certificate about inheritance tax payment

 

 


If you want to sell a house under construction:

  • purchase basis – sale or donation notarial act or court order to acquire the property through inheritance
  • valid copy of the mortgage book
  • actual extract from land register
  • actual certificate of land destination in the city or community development plan (or certificate of lack development plan)
  • building permit (with finality clause given by the relevant UM authority)
  • construction log (breaks in the records must be less than 2 years, otherwise the building permit expires)
  • technical documentation of building – building project

 

 


If you want to sell a housing association owner right to the property:

  • certificate of allocation of flat
  • document testifying complement the contribution of the construction
  • actual certificate that client is a member of the cooperative and he has housing association owner right to the property with a description of it
  • certificate of check-out residents
  • valid copy of the mortgage book (if local have KW)

In case the property doesn`t have a mortgage book, and the buyers want to set up KW (for example, if he buy the property on credit) are additionally required:

  • current copy of mortgage book from land on which the multifamili building is
  • current extract from the plot register of land on which the mulifamily building is

ATENTION

Certificates given by the cooperative can be on a one document.

 

 


If you want to sell property ownership:

  • purchase basis – sale or donation notarial act or court order to acquire the property through inheritance
  • valid copy of the mortgage book
  • current certificate of no arrears in relation to the community/cooperative
  • certificate of check-out residents
