Documents needed to sell real estate in Poland:


Before you start selling your property

Preparing the appropriate documents is one of the elements of a properly conducted property sale process. Equally important, however, is establishing the terms of cooperation with the real estate agent, the method of promoting the property and responsibility for managing the entire process.

If you are selling a plot of land

  • proof of acquisition - notarial deed of sale or donation
  • current extract from the Land and Mortgage Register (issued within the last 3 months)
  • current extract and map extract from the land register
  • current certificate confirming the designation of the plot in the local spatial development plan of the city or municipality (or a certificate confirming that there is no current spatial development plan for the plot)
  • cadastral map
  • property tax assessment decision
  • if the plot is held in perpetual usufruct - the agreement establishing this right and the decision determining the amount of the annual fee are required
  • if the property was inherited - court decision confirming acquisition of the inheritance and a certificate confirming payment of inheritance tax

If you are selling a house (a property developed with a residential building)

  • proof of acquisition - notarial deed of sale or donation
  • current extract from the Land and Mortgage Register (with the building disclosed)
  • current extract and map extract from the land register
  • current certificate confirming the designation of the plot in the local spatial development plan of the city or municipality
  • cadastral map (e.g. map extract from the land register)
  • property tax assessment decision
  • certificate confirming deregistration of residents
  • technical documentation
  • if the property was inherited - court decision confirming acquisition of the inheritance and a certificate confirming payment of inheritance tax

If you are selling a house under construction

  • proof of acquisition - notarial deed of sale or donation, or a court decision confirming acquisition of the property by inheritance
  • current extract from the Land and Mortgage Register
  • current extract and map extract from the land register
  • current certificate confirming the designation of the plot in the local spatial development plan of the city or municipality (or a certificate confirming that there is no current spatial development plan)
  • building permit (with a finality clause issued by the competent authority)
  • construction log (interruptions between entries must be shorter than 2 years so that the building permit does not expire)
  • technical documentation of the building - construction design

If you are selling a cooperative ownership right to a residential unit

  • certificate from the housing cooperative confirming allocation of the apartment
  • document confirming payment of the required construction contribution
  • current certificate from the housing cooperative confirming that the client is a member of the cooperative and holds the cooperative ownership right to the unit, together with a description of the property
  • current certificate confirming that the client has no outstanding financial liabilities towards the housing cooperative
  • certificate confirming deregistration of residents
  • current extract from the Land and Mortgage Register (if a Land and Mortgage Register has been established for the unit)

If the unit does not have a Land and Mortgage Register and the buyer wishes to establish one (for example, when purchasing the property with mortgage financing), the following documents are additionally required:

  • current extract from the Land and Mortgage Register for the plot on which the multi-family residential building is located
  • current extract and map extract from the land register for the plot on which the multi-family residential building is located

Notes

Certificates issued by the housing cooperative may be included in a single document.


If you are selling an ownership right to a residential unit (privately owned apartment)

  • proof of acquisition - notarial deed of sale or donation, or a court decision confirming acquisition of the property by inheritance
  • current extract from the Land and Mortgage Register
  • current certificate confirming that the client has no outstanding financial liabilities towards the housing community/cooperative
  • certificate confirming deregistration of residents
