Purchase of apartments and commercial premises in Bulgaria

Before reviewing the procedures below, it is also worth taking into account the broader market context and macroeconomic changes which may affect purchasing decisions and property price levels in the coming years – particularly following Bulgaria`s entry into the euro area on 1 January 2026. PROCEDURES

Purchase procedure:

Procedures and costs - apartments and commercial premises - BulgariaThe conditions governing the sale and purchase of apartments in Bulgaria are similar to those applicable in other European Union countries, i.e. ownership is transferred by means of a notarial deed executed before the locally competent notary public in Bulgaria. Since 1 January 2026, the official currency of the Republic of Bulgaria has been the euro (EUR), which is also used for settlements relating to property purchase transactions.

The purchase process can be carried out in two ways:

  1. The first option is to purchase an apartment during an investment trip – a personal visit to Bulgaria,
  2. The second option is to purchase an apartment remotely (on-line), without the need to travel to Bulgaria. However, we always encourage clients to choose the first option whenever possible, as it provides an opportunity to become personally acquainted with the area, surroundings and immediate neighbourhood, which can be extremely helpful when making a purchase decision.

Accordingly, we conclude a brokerage agreement both in Poland and locally in Bulgaria, as well as remotely by correspondence. The agreement defines the scope of our obligations and protects the client`s interests.

The purchase of a property under either option involves several basic stages, and the process is comprehensively handled by ILS POLAND GROUP as follows:

  1. Signing the brokerage agreement,
  2. Reservation of the property,
  3. Organisation of the investment trip, including return flights and hotel reservation – where the purchase is to take place during a personal visit to Bulgaria,
  4. Airport pick-up and transfer to the hotel,
  5. Viewing alternative properties according to the criteria specified by the client and presenting current developers` promotions,
  6. At the client`s request, conducting possible negotiations concerning the asking price with the seller, but only before reservation and execution of the reservation-deposit agreement,
  7. Payment of the deposit – most commonly approximately EUR 2,000 – and execution of the reservation-deposit agreement,
  8. In the case of the primary market – translation and negotiation of the terms of the preliminary agreement,
  9. In the case of the primary market – execution of the preliminary agreement and subsequent payments in accordance with the payment schedule specified in it,
  10. Handover and acceptance of the premises, including verification of the actual condition and parameters of the property against the documentation,
  11. Organisation and execution of the transfer of ownership before the locally competent notary public in Bulgaria, either personally by the buyer or on the basis of a previously granted power of attorney.

We would also like to point out that clearly defined intentions of the parties set out in the brokerage agreement provide the client with security of the transaction, while the agreement itself clearly specifies the scope of the intermediary`s obligations and activities required for its completion.

Reservation:

The process of purchasing a secondary-market property selected by the client begins with its reservation, i.e. payment of the agreed deposit for the seller and execution of a reservation-deposit agreement. The standard period required to prepare and complete the transaction is usually approximately 6 weeks, while in individually agreed cases it may be extended to approximately 8 weeks.

Reservation is also important from the seller`s perspective, as after the property has been reserved the seller begins preparing the documentation required for the transaction and, in the case of owners living outside Bulgaria, may also need to organise travel to Bulgaria or appoint an appropriate representative.

IMPORTANT: Any property can be reserved either during a personal visit to Bulgaria or remotely, without the need to travel, by completing and submitting the reservation form available on the page of each property offer in our service.

It should also be emphasised that reservation of a property from our portfolio requires the person making the reservation, after signing a brokerage agreement with our company, to make two payments: one as a deposit for the seller under the reservation-deposit procedure – most commonly approximately EUR 2,000, which is subsequently credited towards the purchase price – and the second as remuneration for ILS POLAND GROUP for comprehensive support and handling of the transaction.

Once the required payments have been credited, we change the status of the property in our service to RESERVED and issue a VAT invoice for the amount of our remuneration.


COSTS

Purchase costs:

In addition to the asking price, the purchase of property in Bulgaria involves costs connected with the notarial transfer of ownership, including in particular:

  1. Notarial and tax costs connected with the transfer of ownership, including the notarial fee, the local tax on the acquisition of property for consideration and the fee for registration of the deed in the Property Register.
    • Notarial fee – this constitutes the remuneration of the notary public and is calculated in accordance with the applicable Bulgarian notarial tariff, depending on the material value of the transaction.
    • Local tax on the acquisition of property for consideration – functionally comparable to property transfer tax or stamp duty known in many other countries – is determined by the competent municipal council. In accordance with Articles 44–51, and in particular Articles 46 and 47 of the Bulgarian Local Taxes and Fees Act (Закон за местните данъци и такси), the tax rate applicable to the acquisition of property for consideration ranges from 0.1% to 3%, with the specific rate being determined by the competent municipality.
    • IMPORTANT: the tax base is the price agreed by the parties; however, if that price is lower than the tax value of the property, the tax is calculated on the higher tax value. In practice, this means that the sale price stated in the notarial deed is compared with the value shown in the tax valuation and the higher of the two values is used for calculating the tax.
    • The fee for registration of the deed in the Property Register amounts to 0.1% of the value serving as the basis for calculating the fee, in accordance with Article 2 of the Tariff of State Fees collected by the Bulgarian Registry Agency.
  2. Return travel and hotel accommodation costs – only where the client chooses the personal-purchase option. These costs are optional, as we also provide comprehensive transaction support without the need to travel to Bulgaria.

Example: for a property priced at approximately EUR 58,000, the combined notarial costs, local tax on acquisition of property for consideration and costs connected with registration of the deed may in practice amount to approximately EUR 2,000–3,000. The final amount depends primarily on the specific municipality, the sale price, the value resulting from the tax valuation and the applicable notarial fees.

Ongoing costs:

In the Republic of Bulgaria, apartments do not operate under the same monthly housing-charge system as, for example, typical cooperative apartments in Poland. Where an apartment is located in a gated residential complex, the owner enters into a management agreement with the company managing the complex, and the annual management and common-area maintenance fee (maintenance of common areas fee) most commonly ranges from approximately EUR 4 to EUR 17 per square metre of the apartment`s total area per year, depending on the particular complex and the scope of services provided.

To illustrate how this fee is calculated, we provide the following example: if a studio apartment has a total area of 27.73 m² and the annual management fee under the management agreement is EUR 10/m², the annual management cost will be:

27.73 m² × EUR 10 = EUR 277.30 per year.

Depending on the particular complex, the management fee may include, among other things:

  • 24-hour reception,
  • security of the complex,
  • cleaning and maintenance of swimming pools,
  • maintenance of landscaped areas,
  • maintenance of parking areas,
  • maintenance of lifts,
  • maintenance of saunas, gyms and other amenities,
  • cleaning and maintenance of common areas,
  • ongoing repairs and maintenance of the complex infrastructure.

IMPORTANT: The scope of services covered by the management fee always depends on the specific agreement concluded with the manager of the particular complex. Therefore, for each property offered by us, we provide the client with the current annual fee known to us and information concerning the operating rules of the particular complex.

Property tax:

The amount of annual property tax depends on the municipality in which the property is located, the type of property and its tax value. Under the Bulgarian Local Taxes and Fees Act, the competent municipal council determines the tax rate within the statutory range of 0.1 to 4.5 per mille of the tax value of the property.

In addition to property tax, the owner also pays, in accordance with the rules applicable in the particular municipality, a local municipal waste fee, the amount of which depends on the competent municipality and the specific property.

Additional charges:

Additional charges are determined primarily on the basis of meter readings and include electricity and water consumption, although in some complexes the management fee may also include certain fixed utility charges settled periodically.

It should also be emphasised that household electricity in Bulgaria is noticeably cheaper than in Poland. Under the settlement system used by us in practice, the owner pays for the electricity actually consumed, and where the apartment is not used during a particular period and there is no consumption, it is possible to receive an electronic statement showing an amount of EUR 0.00. This is also a system with which we are familiar from our own practical use of properties in Bulgaria.

Rental options:

In many apartment complexes, the management company responsible for maintaining the common areas also provides apartment rental management services or cooperates with tour operators and holiday-rental companies. As a result, where such an option is available in the particular complex, the owner may entrust the manager with handling the rental of the apartment.

In practice, remuneration for comprehensive rental management is often determined as a percentage and may amount to approximately 25% of rental revenue or profit, depending on the rules applied by the particular manager. As part of such services, the manager may deal with, among other things, finding tenants, handing over keys, cleaning, laundry and replacement of bed linen and towels, as well as checking the condition of the apartment before and after guests` stays.

The owner may also use individual additional services such as apartment cleaning, laundry or replacement of bed linen and towels. Based on our experience, the cost of a single apartment cleaning may, for example, be approximately EUR 35, while laundry and replacement of bed linen and towels may cost approximately EUR 10. The specific rates always depend on the particular complex and the manager`s current price list.

When entering into a management agreement which includes rental services, the owner usually specifies the periods during which the apartment is to remain available for the owner`s own use, while during the remaining periods it may be offered for rent. In Bulgarian Black Sea resorts, the main rental season falls primarily between May and October.

Sample/draft rental management agreement:

The terms of rental-management agreements are determined by the individual managers of each complex and may differ significantly. In many cases, management companies do not make complete draft agreements available in advance to persons who are not yet apartment owners. Therefore, detailed conditions relating to rental, the scope of services, the manager`s remuneration and the settlement method should always be analysed in relation to the particular complex and the specific agreement.

Potential returns:

Although ILS POLAND GROUP does not provide apartment rental management services, we have many years of experience resulting from contact with clients who purchased properties in Bulgaria through our company and subsequently made them available for rent. Based on this experience, rental during the season from May to October may generate for the owner an average of approximately EUR 2,500 for a studio apartment, approximately EUR 3,500 for a one-bedroom apartment and approximately EUR 4,500 for a two-bedroom apartment, after taking into account basic management and operating costs.

It should be emphasised that these are average figures, as the actual result depends to a very significant extent on the location, standard of the complex, distance from the beach, standard and furnishing of the apartment, its size, floor, views from the windows and balcony, as well as the length and manner in which the rental season is utilised. Even within the same complex, an apartment with a direct view of the swimming pool and sea may generate significantly higher rental income than a property of comparable size overlooking a car park or road.


Cost of comprehensive ILS POLAND GROUP services

ILS POLAND GROUP provides comprehensive support and handling of every transaction – both for properties available in our own property portfolio and for properties identified by the client from other sources.

In the case of a secondary-market property purchase, the remuneration of ILS POLAND GROUP amounts to 3% net of the value stated in the executed transfer-of-ownership agreement + 20% Bulgarian VAT, but not less than EUR 1,650 net, i.e. EUR 1,980 gross. We issue a VAT invoice for our remuneration.

Example 1: for a property priced at EUR 58,000, remuneration at 3% amounts to EUR 1,740 net and, after adding 20% Bulgarian VAT, EUR 2,088 gross.

Example 2: for a property priced at EUR 50,000, 3% of the purchase price would amount to EUR 1,500 net. Therefore, the minimum ILS POLAND GROUP remuneration applies, amounting to EUR 1,650 net, i.e. EUR 1,980 gross.

LOYALTY DISCOUNT PROGRAMME: Clients who, after purchasing a property through ILS POLAND GROUP, decide to purchase another property with us may benefit from our loyalty discount programme. For the purchase of a second property, we provide a 5% discount on ILS POLAND GROUP remuneration, while for the purchase of a third and each subsequent property we provide a 10% discount. The discount is calculated on the remuneration determined in accordance with the standard rate applicable to the particular transaction, subject to the minimum ILS POLAND GROUP remuneration, which currently amounts to EUR 1,650 net + 20% VAT, i.e. EUR 1,980 gross. This means that application of the discount may not reduce our remuneration below the applicable minimum amount.

The amount of our minimum remuneration is not subject to individual negotiation, as it constitutes the lower limit of remuneration adopted under the comprehensive transaction-support model which we have developed over almost 20 years of activity on the Bulgarian real estate market – since 2008 – and which we apply consistently to all our clients. Our remuneration reflects both the scope of activities performed by us and the organisational costs we incur, as well as our responsibility for the correct, comprehensive and secure conduct of the entire purchase process.

In the case of properties purchased on the primary market, the intermediary`s remuneration may be paid by the developer, in which case the buyer does not incur the cost of ILS POLAND GROUP commission. The client is always informed of the applicable remuneration rules before the purchase procedure begins.

Option 1 – personal purchase in Bulgaria:

If the client travels to Bulgaria and signs the notarial deed personally, there is no need to prepare a power of attorney in the client`s home country.

During execution of the notarial deed, we provide the client with translation of the contents of the documents through our representatives / members of the ILS POLAND GROUP team in Bulgaria, in accordance with the procedure adopted by the competent notary public. Where, under the applicable regulations and the requirements of the competent notary public, formal participation of an interpreter is required, this takes place in accordance with the procedure provided for in Article 582 of the Bulgarian Code of Civil Procedure.

Under this option, the client does not incur notarial costs in the client`s home country relating to the preparation of a power of attorney, nor the costs of translations of documents required where the purchase is carried out through an authorised representative.

Option 2 – purchase without travelling to Bulgaria:

If the client decides to purchase a property without travelling to Bulgaria, we prepare the complete set of documents, declarations and powers of attorney required for the transaction.

In such a case, the following additional costs should generally be taken into account:

  • preparation of the power of attorney and required declarations before a notary public in the client`s country – in accordance with the applicable notarial tariff in that country,
  • where required, certification, legalisation or apostille of the relevant notarised documents in accordance with the rules and fees applicable in the country in which the documents are executed,
  • delivery of the original documents to Bulgaria by a courier company selected by the client,
  • preparation of the required translations and appropriate preparation of the documents for use in Bulgaria – typically approximately EUR 100–150, depending on the number of documents and the rates applicable at the relevant time.

The exact amount of these additional costs depends on the number of documents prepared, the country in which they are executed, the selected notary public, the number and type of required certifications, the scope of translation and the selected courier company.

IMPORTANT: Regardless of whether the client chooses a personal purchase in Bulgaria or a fully remote purchase, the amount of ILS POLAND GROUP remuneration remains the same, as in both cases we provide comprehensive organisation and handling of the entire transaction.

ILS POLAND GROUP remuneration includes, among other things:

  1. organisation of the entire purchase procedure,
  2. preparation of documentation required for completion of the transaction,
  3. cooperation with the locally competent notary public,
  4. obtaining a BULSTAT number where, under the applicable regulations, it is required for the particular activity or due to the buyer`s circumstances,
  5. assistance with opening a bank account in Bulgaria where this is required or used in the adopted method of conducting and settling the transaction,
  6. preparation of documents required by the bank,
  7. preparation of the buyer`s documents and declarations for the notary public,
  8. organisation of payment of the deposit for the seller and the reservation-deposit procedure,
  9. conducting the transaction at the notary`s office together with the client or on the basis of a previously granted power of attorney,
  10. assistance during execution of the notarial deed,
  11. collection of the notarial deed following its registration,
  12. notification of the property to the competent municipality where, in the particular transaction, an appropriate notification by the new owner is required,
  13. notification of the new owner to the complex manager and assistance with conclusion of the management agreement,
  14. assistance with transferring electricity and water accounts/meters to the new owner,
  15. performance of required activities on the basis of a power of attorney where the client does not remain in Bulgaria,
  16. delivery of the complete set of documents to the client by courier after completion of the procedure, where necessary.

NOTE: ILS POLAND GROUP also provides comprehensive after-sales support, including assistance with furnishing and equipping apartments on the basis of individual arrangements or separate agreements.

Citizens of Poland and other European Union and European Economic Area countries may acquire ownership of real estate in Bulgaria as natural persons, including houses together with the land and building plots, without the need to establish a Bulgarian company for this purpose. In the case of agricultural land, forests or properties with a special legal status, before reservation we verify the current legal status of the property and the possibility of its acquisition by the specific buyer,
  8. Organisation and execution of the transfer of ownership before the locally competent notary public in Bulgaria, either personally by the buyer or on the basis of a previously granted power of attorney, with the proviso that the seller will usually expect the entire remaining purchase price to have been paid by that stage, in accordance with the conditions previously agreed between the parties.

IMPORTANT: When purchasing a house or land in Bulgaria, verification of the legal status of the property is particularly important. Before completing the transaction, we verify documentation concerning ownership rights, possible encumbrances, the status and designated use of the plot and – depending on the type of property – documentation concerning the buildings located on it, access to the road and other circumstances relevant to a safe purchase.

We would also like to point out that clearly defined intentions of the parties set out in the brokerage agreement provide the client with security of the transaction, while the agreement itself clearly specifies the scope of the intermediary`s obligations and activities required for its completion.

In order to address possible concerns and one of the questions most frequently asked by our clients, we emphasise that houses with land and plots offered by us on the secondary market come directly from owner-sellers and are always checked by us from the formal and legal point of view.


COSTS

Purchase costs:

In addition to the asking price, the purchase of land, a house together with a plot or a building plot in Bulgaria involves, in particular, the following costs:

  1. Costs connected with the notarial transfer of ownership of the property, including the notarial fee, the local tax on the acquisition of property for consideration and the fee for registration of the deed in the Property Register.
    • Notarial fee – this constitutes the remuneration of the notary public and is calculated in accordance with the applicable Bulgarian notarial tariff, depending on the material value of the transaction.
    • Local tax on the acquisition of property for consideration – functionally comparable to property transfer tax or stamp duty known in many countries – is determined by the competent municipal council. In accordance with Articles 44–51, and in particular Articles 46 and 47 of the Bulgarian Local Taxes and Fees Act (Закон за местните данъци и такси), the tax rate applicable to the acquisition of property for consideration ranges from 0.1% to 3%, with the specific rate being determined by the competent municipality.

In the case of a secondary-market property purchase, the remuneration of ILS POLAND GROUP amounts to 3% net of the value stated in the executed transfer-of-ownership agreement + 20% Bulgarian VAT, but not less than EUR 1,650 net, i.e. EUR 1,980 gross. We issue a VAT invoice for our remuneration.

Example 1: for a property priced at EUR 58,000, remuneration at 3% amounts to EUR 1,740 net and, after adding 20% Bulgarian VAT, EUR 2,088 gross.

Example 2: for a property priced at EUR 50,000, 3% of the purchase price would amount to EUR 1,500 net. Therefore, the minimum ILS POLAND GROUP remuneration applies, amounting to EUR 1,650 net, i.e. EUR 1,980 gross.

LOYALTY DISCOUNT PROGRAMME: Clients who, after purchasing a property through ILS POLAND GROUP, decide to purchase another property with us may benefit from our loyalty discount programme. For the purchase of a second property, we provide a 5% discount on ILS POLAND GROUP remuneration, while for the purchase of a third and each subsequent property we provide a 10% discount. The discount is calculated on the remuneration determined in accordance with the standard rate applicable to the particular transaction, subject to the minimum ILS POLAND GROUP remuneration, which currently amounts to EUR 1,650 net + 20% VAT, i.e. EUR 1,980 gross. This means that application of the discount may not reduce our remuneration below the applicable minimum amount.

The amount of our minimum remuneration is not subject to individual negotiation, as it constitutes the lower limit of remuneration adopted under the comprehensive transaction-support model which we have developed over almost 20 years of activity on the Bulgarian real estate market – since 2008 – and which we apply consistently to all our clients. Our remuneration reflects both the scope of activities performed by us and the organisational costs we incur, as well as our responsibility for the correct, comprehensive and secure conduct of the entire purchase process.

Option 1 – personal purchase in Bulgaria:

If the client travels to Bulgaria and signs the notarial deed personally, there is no need to prepare a power of attorney in the client`s home country.

During execution of the notarial deed, we provide the client with translation of the contents of the documents through our representatives / members of the ILS POLAND GROUP team in Bulgaria, in accordance with the procedure adopted by the competent notary public. Where, under the applicable regulations and the requirements of the competent notary public, formal participation of an interpreter is required, this takes place in accordance with the procedure provided for in Article 582 of the Bulgarian Code of Civil Procedure.

Under this option, the client does not incur notarial costs in the client`s home country relating to the preparation of a power of attorney, nor the costs of translations of documents required where the purchase is carried out through an authorised representative.

Option 2 – purchase without travelling to Bulgaria:

If the client decides to purchase a property without travelling to Bulgaria, we prepare the complete set of documents, declarations and powers of attorney required for the transaction.

In such a case, the following additional costs should generally be taken into account:

  • preparation of the power of attorney and required declarations before a notary public in the client`s country – in accordance with the applicable notarial tariff in that country,
  • where required, certification, legalisation or apostille of the relevant documents in accordance with the rules and fees applicable in the country in which the documents are executed,
  • delivery of the original documents to Bulgaria by a courier company selected by the client,
  • preparation of the required translations and appropriate preparation of the documents for use in Bulgaria – typically approximately EUR 100–150, depending on the number of documents and the rates applicable at the relevant time.

The exact amount of these costs depends on the number of documents prepared, the selected notary public, the number and type of required certifications, the scope of translation and the selected courier company.

IMPORTANT: Regardless of whether the client chooses a personal purchase in Bulgaria or a fully remote purchase, the amount of ILS POLAND GROUP remuneration remains the same, as in both cases we provide comprehensive organisation and handling of the entire transaction.

ILS POLAND GROUP remuneration includes, among other things:

  1. organisation of the entire purchase procedure,
  2. preparation of documentation required for completion of the transaction,
  3. cooperation with the locally competent notary public,
  4. obtaining a BULSTAT number where, under the applicable regulations, it is required for the particular activity or due to the buyer`s circumstances,
  5. assistance with opening a bank account in Bulgaria where this is required or used in the adopted method of conducting and settling the transaction,
  6. preparation of documents required by the bank,
  7. preparation of the buyer`s documents and declarations for the notary public,
  8. organisation of payment of the deposit for the seller and the reservation-deposit procedure,
  9. conducting the transaction at the notary`s office together with the client or on the basis of a previously granted power of attorney,
  10. assistance during execution of the notarial deed,
  11. collection of the notarial deed following its registration,
  12. notification of the property to the competent municipality where, in the particular transaction, an appropriate notification by the new owner is required,
  13. assistance with transferring electricity and water accounts/meters to the new owner,
  14. performance of required activities on the basis of a power of attorney where the client does not remain in Bulgaria,
  15. delivery of the complete set of documents to the client by courier after completion of the procedure, where necessary.

NOTE: ILS POLAND GROUP also provides comprehensive after-sales support, including assistance with major renovations of houses as well as furnishing and equipping houses on the basis of individual arrangements or separate agreements.
